By using the Planimage.com site in any way, you are agreeing to comply with these terms and conditions. If you do not want to be bound by these terms and conditions, you should not use the site and should not order products through the site.

TERMS OF USE

• Governing Laws

These Terms and Conditions are governed by the laws of the Province of Québec and the laws of Canada applicable therein. The parties agree that in the event of any difference, disagreement and / or litigation between them, the only competent district where all cases will be heard is the judicial district of Longueuil.

• Restrictions of Use

All plans and illustrations presented on this site are the exclusive property of Planimage.com. Under the federal Copyright Act, any reproduction in whole or in part is prohibited by law and constitutes a violation. The purchase of a construction plan does not allow the buyer to use the model for advertising purposes. Furthermore, the purchase of a set of plan grants you the right to build only one unit.

• Trademarks

Trademarks and logos used and displayed on this site are registered and unregistered trademarks of Planimage.com or third parties. The use of trademarks appearing on this site requires the written permission of the trademarks owner.

• Limitation of Liability

The plans and/or products on the Planimage.com site are provided "as is" without warranties and conditions of any kind, either express or implied. Subject to any public legislation to the contrary, Planimage.com declines any responsibility and provides no warranties, expressed or implied, particularly with regards to merchantability or sustainability for any particular use. Planimage.com shall not be liable for any direct, indirect, incidental or consequential damages, including, but not limited to, loss of profit or business opportunity arising out of the use or the inability to use the products, the architectural and design services or the construction plans available on this site. The buyer/customer is responsible for validating the accuracy of the plans and/or products and making sure they meet local and regional authorities’ requirements prior to their use. In the event that Planimage.com is held liable, the obligation of Planimage.com would be limited to the reimbursement (without exceeding) of the price paid to Planimage.com for the product, plan or service purchased. All the plans available on the Planimage.com site meet the standards of the Canadian National Building Code in force.

• Construction Standards

House plans presented by Planimage abide by specific construction requirements. However, since construction standards and building codes vary a lot from one province, town or country to another, Planimage cannot guarantee that all plans fully comply with the standards of the countries, provinces or municipalities where plans are purchased and where houses will be built. Furthermore, because of various factors, mainly climate differences, force of wind, abundance of rain or snow falls, or the types of soil—clayey or sandy— in seismically active areas, amongst others, Planimage cannot guaranty full compliance of these plans. To make sure that a plan meets the construction standards and regulations of your province, town or country, you will have to verify with local builders, contractors or other authorities concerned. Also, the person who purchases the plan is responsible for verifying with the appropriate authorities that this plan meets the standards in force before starting to build, as Planimage assumes no responsibility in this regard.

SALES CONDITIONS

• Price

The purchase price for each product and/or plan that you order is the price that appears on this Web site next to each product. It does not include shipping charges and applicable taxes. Planimage.com reserves the right to modify, without advance notice, in whole or in part, the price of products and plans offered on this Web site at anytime. All prices indicated are in Canadian dollars.

• Returns

The products and/or plans sold on the Web site cannot, under any circumstances, be returned for a refund or a credit.

• Product Availability

The Planimage.com site displays all the products and plans available for purchase. Planimage.com constantly updates its plan collections to ensure that the plans comply with the changes and amendments made to the National Building Code from time to time. This is why plans can occasionally and temporarily be held before shipment. Should the shipping delay be prejudicial to you, Planimage.com will then inform you. In the event of a product back order, Planimage.com will fill and ship the order as soon as the product becomes available. Planimage.com shall never be liable for any direct, indirect, incidental or consequential damages suffered because of a back order or a plan revision.

• Shipping

Planimage.com will ship the products and/or plans ordered at the address given when placing the order. Planimage.com will proceed with the shipment once the order has been accepted and approved, and in accordance with the shipping method you have selected. Shipping delays and charges can vary according to the shipping destination, the shipping method selected and product and/or plan availability. Shipping delays are estimated from the time the products and/or plans leave Planimage.com’s place of business. You become the owner of the products and/or plans ordered once the transport company picks up the products and/or plans you have purchased. From that moment on, you bear all the risks and Planimage.com will not be held liable for their loss or destruction. You are also responsible for all the charges relating to customs and/or export of the products and/or plans outside of Canada. The shipment of the products and/or plans is subject to the policies of the transport companies used by Planimage.com. Products and/or plans will not be shipped to a post office box.
Planimage will ship your order to the address given assuming that someone will be available to sign when receiving the merchandise. If you don’t need someone to sign for your order, please uncheck the box regarding this signature. Planimage will not be held responsible in case of lost or theft of your order.

The Ontario Provincial Government's Bill 124, which became effective on January 1^st, 2006, stipulates that a Building Code Identification Number (BCIN) is required on all construction plans submitted for a building permit. Planimage is duly accredited to provide a BCIN number, but may need 3 additional days to deliver plans in Ontario.

• Force Majeure

Planimage.com shall not be held liable for any delay, failure to fulfill, in whole or in part, any of its obligations, nor for the damages or losses resulting from such failure to fulfill, if said failure occurs as a result of an Act of God or from such circumstances beyond the control of Planimage.com.
